DAVID MACMILLAN IN COUNTY JAIL
Florence Jones, Eleven Years Old, Accuses Him of a Terrible Crime.
OAKLAND, March 12. - David MacMillan, superintendent of the Union Men's Orphanage at San Lorenzo, was arrested this afternoon by Constable Manuel Berge of San Leandro on complaint of Florence Jones, an eleven-year-old inmate of the orphanage, sworn to before Justice of the Peace, D. U. Teffelmier of San Leandro. According to the story told the Justice by the girl, her abuse by MacMillan commenced on August 28th last. She was accompanied to the office of the Justice of the Peace by her mother, Mrs. Daniel Jones. McMillan was unable to furnish bail and was taken to the County Jail. Justice Teffelmier has set the hearing for tomorrow morning at 10 o'clock. This is the second time MacMillan has faced such a charge. About a year ago he was accused by the little daughter of John Blackson, formerly a conductor on the central division of the Oakland Traction Company, but after a thorough investigation the charge was dismissed. MacMillan was formerly a motorman on the Hayward division of the street railway. He resigned nearly two years ago to organize the orphanage at this place. Since then he has been connected continuously with the institution. It was a result of his efforts that the union men of California finally took hold of the orphanage and formed a stock company to run it, many of the unions taking stock in it. At present there are twenty-seven children in the orphanage. The institution is situated in the midst of beautiful grounds, and has an unexcelled location. Pending the examination of MacMillan his wife has been put in charge of the orphanage by the board of directors. She is heartbroken over the charge made against her husband, and refuses to believe it. She declares it is impossible, as the girl's room has been locked at night, and she alone has the key. MacMillan asserts his innocence of the charges brought against him by Florence Jones. He claims that Mrs. Marshall Johnson, a former matron at the orphanage, and James French, a former director, who, he says, wishes to be made superintendent, have instigated the charges. He also charges Mrs. Bissell, wife of the pastor of the Congregational Church in San Leandro, with jealousy, because he had refused to attend the church. The warrant for McMillan's arrest was issued at the request of Deputy District Attorney Philip Carey, who saws he has made a thorough investigation of the girl's charges. He says she told a very straightforward story.

McMillan Acquitted On Charge of Girls
Daniel McMillan, charged with assault upon a young girl inmate of the Union Men's Orphanage, of San Lorenzo, of which he was superintendent, was Wednesday acquitted by a jury that sat before Judge Preweld. McMillan was once before accused of a similar offense, but was never brought to trial. He is a married man with a family, and sat in court holding his young children much of the time. Attorney P. M. Walsh, McMillan's attorney, for the second time fell under the displeasure of the court Wednesday for tardiness, and was fined $20 by Judge Prewell. The case was set to begin by 9:30 o'clock. Several days before Judge Prewell fined Walsh $5 for being late, but remitted the fine upon the attorney explaining that he had misunderstood the hour at which court would convene. But Judge Prewell announced that the fine imposed today must be paid.
