Parole Violator Gets New Chance

If you think policemen don't have hearts, ask Jack Lee Webster and he'll set you straight. You'd have to go to Council Bluffs, Iowa, to talk to Jack - because that's where he's trying to get a fresh start after almost being returned to Portland as a parole violator. Jack, 18, who moved to Portland with his parents from Council Bluffs two years ago, got into trouble last year for stealing $5 from St. Stephen's Catholic Church at SE 41st Ave. and Salmon St. In April, Presiding Circuit Judge Charles W. Redding placed him on three years' probation.

Federal Charge Filed.

Later, he returned to Council Bluffs without permission of his parole officer and got a job as a bellboy. Leo Smith, then district attorney, secured a federal fugitive warrant for Jack and the FBI picked him up a month ago. Last week, County Detective Walt Graven was sent to Iowa to return Webster. On his arrival he found the whole Council Bluffs police department in Jack's corner. In brief their story was - "Jack's a good boy, he's never been in trouble here, his home town, and he's trying to go straight. Isn't there some way. he can stay?" At Graven's suggestion a Council Bluffs police captain telephoned Chief Criminal Deputy Dist. Atty. Glenn A. Geurts, who conferred with his boss, Dist. Atty. Charles E. Raymond. Geurts and Raymond decided, and Judge Redding concurred, that Jack's and justice's best interests would be served if the boy were to remain in Council Bluffs - where the police department agreed to assume responsibility for him and assign an officer to take him under wing.

Prisoner Left Behind

So, Graven was back in Portland Monday, empty-handed but with a full heart. His trip cost the sate of Oregon about $210 but he thinks it is a small price to pay for for a boy's future. Graven said the Webster youth has a promise of a better job, as a service station attendant. He quoted the youth: "I won't let them down - not after the way they stuck out their necks for me." The boy has also started attending church, Graven added. The case is similar to one last fall in which Circuit Judge Alfred T. Sulmonetti decided against returning a parole violator from California  after a deputy was sent to bring him back. That trip cost $210 but the judge figured it would be cheaper in the long run to give the man a chance to make good.

Judge Redding sentences Pair

Sentences imposed by Presiding Circuit Judge Charles W. Redding on guilty pleas this week included Moses W. Irvin, Jr., three years in the Oregon State penitentiary on a charge of illegal possession of narcotics. and Ernest Owen, 20, two years at the Oregon Correctional institution on a bad check charge.

Execution of sentence on Larry P. Stubbs, who pleaded guilty to an unarmed robbery charge, was suspended for three years when the court was told he faces a federal charge. Bail on Ray Malott, charged with contributing to the delinquency of a minor, was forfeited when his attorney, Edmund Jordan, informed the court he had been unable to find him. Malott failed to appear in court twice. A bench warrant for his arrest was issued at request of the district attorney.

Auto Collision Injures Two

Two persons were injured, one seriously, in a two-car accident at N Lombard St. and Denver Ave. about 7 p.m. Sunday night. Donna M. Dickerson, 17, of 9206 N Buchanan Ave., was taken to Bess Kaiser Hospital with undetermined injuries. Edward D. Matthias, 21, of 9203 N Central St., was transported home with minor injuries. Police said a car driven by George E. Palmer, 61, of Kalama, Wash., traveling east on Lombard St., made a left turn and hit the car driven by Matthias broadside. Both men said they did not see the other before the impact.

Two Accused Of Burglary

Police booked two men on accusations of burglary Friday in connection with the ransacking of a tavern and fountain lunch in southeast Portland, officers reported. Held in lieu of $6,000 bail each were Jack Lee Webster, 25, 5212 SE Tolman St., and Larry Phillip Stubbs, 27, of 1235 SE Yamhill St. Officers said the two were arrested near Scotty's Tavern, 5932 SE 82nd Ave., which had been burglarized. A car found nearby had a trunk full of grocery items, they said. While the arrest was taking place, Louis White, owner of the Harold Street Fountain Lunch at 9236 SE Foster Rd., told police his establishment had been burglarized. Police said he identified the articles found in the trunk as having been taken from his store.

Court Drops Drug Count Against Accused Inmate

SALEM - Unwarranted costs and security risks were given as causes for dismissal of a narcotic drug case Tuesday in Marion County Circuit Court. Dist. Atty. Gary Gortmaker asked that the charges be dismissed against Larry Phillip Stubbs, a state penitentiary inmate from Multnomah County. He was accused of having marijuana in his possession Dec. 31 in the penitentiary. The motion for dismissal came after it was discovered Stubbs had called numerous inmates and officials to testify. Gortmaker said the case isn't worth the cost or the risk. Stubbs is serving five years for burglary. When Stubbs was taken into custody by guards, he didn't have marijuana in his possession, Guards said, however, they saw him pass it to another inmate, from whom it was recovered. The drug was smuggled into the penitentiary.

City police seize two truckloads of merchandise

City vice officers seized two truckloads of merchandise and arrester two occupants of a Northeast Portland home early Tuesday. Police said they believe the radios, televisions, guns and jewelry which they hauled from the house at 25524 NE Flanders St. are stolen. Arrested were Robert Poitras, 29, of the Flanders Street address, and Larry P. Stubbs, listed as a transient. Poitras was accused of possession of dangerous drugs, possession of narcotics and with being an ex-convict in possession of firearms. He was held in lieu of $12,000 bail. Stubbs was arrested on warrants stemming from three traffic charges. Police said they discovered a bag of marijuana, more than 1,000 pill, six packets of Methamphetamine (speed) and a container of heroin in their search of the house. The recovered merchandise was carted off in two trucks and stored in the police garage.

Branch bank loses $4,000 in holdup

A gunman escaped with $4,000 Monday after holding up First National Bank's NE 122nd Avenue and Halsey Street branch. Bank officials said the man handed a teller a note reading "This is a holdup. I have a gun and I'll use it if I have to. He also handed her a paper bag and told her "Hurry up. And give me the big bills." The robber opened his coat to display a pistol. A bank official noticed the robbery in progress and set off an alarm, but just before the sheriff's deputies arrived the robber and a second man who had been waiting in a car outside fled the scene. The getaway car was found less than a mile from the bank. Police said it had been stolen. The holdup man was described as white between 5 feet 6 inches and 5-9, wearing a white shirt, dark tie, sport jacket, hat and dark glasses. He had a large scar on his left cheek.

Bank suspect waives hearing

A 33-year-old man subdued by nurses at Oregon City hospital Nov. 12 after he walked in and demanded drugs, has been accused of being the same gunman who last August held up a bank and accidentally shot himself in the groin. Larry Phillip Stubs, a transient who has been held in the Clackamas County jail since the Nov. 12 incident, waived preliminary hearing Tuesday before U.S. Magistrate George E. Juba. He was charged last Friday with robbing the Menlo Park branch of U.S. National Bank Aug. 6. Stubbs, an unemployed construction worker, was originally arrested after he walked into the hospital about 4:30 a.m., brandished a .22-caliber automatic gun and ordered nurses at the front desk to hand over drugs. The nurses, joined by an ambulance driver, overpowered and disarmed him. In the bank robbery, Stubbs is accused of escaping with about $3,997. Witnesses said that a man wearing dark glasses and T-shirt stepped up to the teller's window with one hand in his pocket, a muffled shot rang out. The man, grimacing with pain, then demanded money from the teller and hobbled out with it photographed on the way by the bank security camera. Assistant U.S. Atty. D. Richard Hammersley said Stubbs, currently is being held in lieu of $50,000 bail.

Drug Store Burglary Suspect Kills Himself

Larry Phillip Stubbs, 33, no known address, shot and killed himself early Saturday when police, responding to a report of a burglary, attempted to apprehend him inside the Hawthorne Pharmacy, 3538 SE Hawthorne Blvd., Portland police reported. Officers said they were informed of a burglary in progress at the drug store and attempted to enter through a back window, the same means of entry used by the burglar. They heard a shot, and found the body of the man, shot once in the head with a .38 caliber revolver. Stubbs was pronounced dead at the scene.

Change of plea sought in bank robbery case

Chief U.S. Dist. Judge Robert C. Belloni took under advisement Wednesday an accused bank robber's request to change his plea from guilty to innocent. Jack Lee Webster, 31, pleaded guilty in U.S. District Court Jan. 19 to robbing the 122nd Avenue and Halsey Street branch of the First National Bank of Oregon Sept. 27, 1971. Webster's attorney told the court Wednesday the defendant wished to change his plea on grounds he had been forced to plead guilty after threats to his life by another accused bank robber, Larry Phillip Stubbs. Stubbs had pleaded guilty at the same time to robbing the Menlo Park branch of the U.S. National Bank of Oregon Aug. 6, 1971. Indictments indicated both men were implicated in each of the robberies, but second counts were dropped by the U.S. Attorney upon the guilty pleas. Stubbs, released on bail pending results of a pre-sentence investigation, shot and killed himself Feb. 26, apparently in the course of a burglary at the Hawthorne Pharmacy, 3538 SE Hawthorne Blvd. Police said they found Stubbs dead in the pharmacy after responding to burglar alarm during the early morning hours. Webster said Stubbs had forced him to admit the Sept. 27 bank robbery.

Judge rejects change in plea by suspect

A robbery suspect's attempt to change his plea to not guilty was denied by Senior U. S. District Judge Gus J. Solomon Wednesday after the death of a codefendant in the crime. In a lengthy opinion, Solomon wrote that Jack Lee Webster had lied to the court when he said Larry Stubbs threatened to kill him unless he pleaded guilty to the Sept. 27, 1971, robbery of the NE 122nd Avenue and Halsey Street branch of the First National Bank of Oregon. Both men pleaded guilty in January to separate robberies in which both were implicated, the Sept. 27 holdup and the Aug. 6, 1971 robbery of the Menlo Park branch of the United States National Bank. After plea bargaining in which additional charger were to be dropped, Stubbs pleaded guilty to the Menlo Park robbery and Webster to the Halsey Street holdup. On Feb. 27, while on bail, Stubbs committed suicide during a burglary. On March 15, Webster moved to withdraw his guilty plea. At a hearing Webster testified that Stubbs had threatened and physically abused him while both shared a holding cell in the U.S. marshal's office and at Rock Butte Jail. A prisoner in an adjoining cell, Donald Orand, corroborated Webster's testimony. "I do not believe either Webster or Orand. heir testimony was fabricated to take advantage of the recent death of Stubbs, the only person who could deny Webster's allegations of coercion," Solomon said in the opinion. Solomon recounted testimony of a guard that Webster had bragged about committing the robberies. He also reviewed the open and voluntary circumstances in which Webster gave his confession. "The right to withdraw a guilty plea is not absolute," Solomon ruled.. "It lies with the discretion of the trial court."

Judges sentences 2, lashes guidelines

In another sentencing, Burns ordered Lisa Marie Holzer, 25, of Portland, to serve four years and two months in prison for robbing one bank. Under the guidelines, with good behavior time, Holzer will be released in about three years, four months.
